Prostitution laws in Kuwaitالكويت
Kuwait's Penal Code (Law No. 16 of 1960) contains no offence aimed specifically at people who sell sex, but sex between a man and a woman aged 21 or over who are not married to each other is punishable by six months to three years for both if they are caught in the act (Art. 194); adultery by a married person carries up to five years (Art. 195). Inciting or helping a person into prostitution carries up to one year and/or a fine (Art. 200), up to five years with coercion (Art. 201); living off another's prostitution up to two years (Art. 202); running a brothel up to seven years and a fine of up to KWD 7,000 (Art. 203); and public incitement to prostitution in a public place up to three years and/or KWD 3,000 (Art. 204). A ministerial committee set up in August 2025 is drafting a new Penal Code.
Legal model
Selling and buying prohibited. Selling sex is an offence (criminal or administrative), whether or not buying is.
No Penal Code provision punishes the person who sells sex as such. Selling and buying are offences through the general provision on consensual sex outside marriage: a man and a woman aged 21 or over caught in the act face six months to three years (Art. 194, Penal Code of 1960). Inciting or assisting prostitution, living off it, running a brothel and public incitement are separate crimes (Arts. 200 to 204).[1]
